TERMS OF PARTICIPATION AND REGISTRATION
To become a member of the Stars PH Panel, you need to register with Stars PH and create a Stars PH
Account on one of the Platforms (“Stars PH Account”) by following the registration process.
Potential members must complete a Stars PH Account registration form to be part of the Stars PH Panel.
Stars PH registration forms may include:
- Registration form available on Stars PH surveys progressive web application
- Registration form available on Stars PH website
SURVEY
RESPONDENTS:
Eligibility
Requirement:
Users must be at least 18 years old to participate in any activities
on the Stars PH Panel or any of its Platforms. By accessing or using the Platforms, you confirm that
you meet this age requirement. If you are under 18 years old, you are not permitted to participate
in any activities on the Platforms.
In consideration of Stars PH accepting your
application for a Stars PH Account and granting you a Stars PH Account, access to be a member of the
Stars PH Panel, and/or to use of the Platforms, you agree to:
Provide
accurate and complete information about yourself as prompted by the Stars PH Registration process,
both for Stars PH website and mobile application;
Keep and promptly update your personal details, including your Stars PH Account, so as to keep
it true, accurate, current and complete;
Provide honest and accurate survey responses to the best of your knowledge and ability.
You
are not permitted to participate in any of Stars PH's activities or on any of the Platforms if you
are a minor. Notwithstanding you must be 18 years or older to participate on the Platforms. Where
you are 18 years of age or older but are still considered to be a minor in your country of
residence, you shall obtain the permission of your parents or legal guardians whom we assume approve
your use of the Platforms and have read and agreed to these Terms. As far as is permitted by law,
Stars PH accepts no responsibility regarding any activities which may be conducted by minors without
the permission of their parents or legal guardians.
If you are a parent or legal guardian and
you give your permission for your child to register and participate in any Stars PH activities or to
use any of the Platforms, you shall be deemed to have read and agreed to these Terms by your minor.
You will also have to be a citizen of, or permanently residing in the Philippines to be eligible to
participate on the Platforms.
By accessing or using the Platforms, you represent
and warrant that you meet the eligibility requirements set out above. In the event that you do not
meet any of the eligibility requirements, Stars PH has every right to suspend your use of any of the
Platforms, including your right to claim any rewards without liability for compensating you for the
loss of use of the Platforms or any loss of right to any rewards.
If you
provide any information that is suspected to be untrue, inaccurate, not current or incomplete, Stars
PH has the right to suspend or terminate your Stars PH Panel membership, Stars PH Account and or use
of the Platforms. Any Points accrued in suspended or terminated Stars PH Accounts may be
forfeited.
Only one Stars PH Account is permitted per member for which Points is
awarded. Any member found to have multiple Stars PH Accounts may have all of his/her Stars PH
Accounts terminated without notice and any Points accrued in such additional Stars PH Accounts will
be forfeited. Stars PH reserves the right to retract, reclaim or seek reimbursement for any rewards
claimed or prizes won through unauthorized additional Stars PH Accounts. Stars PH may demand proof
of identity in the event of a dispute. A unique email address must be used in respect of each Stars
PH Account.
Members may accrue Points for their Stars PH Account in the manner
prescribed by Stars PH, which includes participating in any activities for which Points is awarded.
The amount of Points accrued for participation in such activities will be notified to members via
authorized communications.
Temporary email addresses are not acceptable
forms of email addresses allowed on Stars PH or any of its Platforms. Any Stars PH Account found
associated with a disposable or throwaway email address may have all of their Stars PH Accounts
terminated without notice and any Points accrued in such additional Stars PH Accounts will be
forfeited.
Each member should use their own personal mobile device to create
their Stars PH Account. Members are not allowed to access more than one Stars PH Account on their
personal mobile device, or share mobile devices to use the Platforms. Doing so may result in
members’ Stars PH Account being suspended, cancelled, or both.
Each Stars PH
Account must only be accessed by the individual member whose unique email address was used for
registration, and may not be accessed by any other individual without the written permission and
authorization of Stars PH. You agree to notify Stars PH immediately when you become aware of, or
suspect any unauthorized use of your login information, Stars PH Panel account, or any other breach
of security.
In the event that another individual accessed your Stars PH Account,
Stars PH reserves the right to suspend the account until a resolution has been reached. Stars PH may
reclaim any Points or incentive earned by the access of the unauthorized user, for which the member
or unauthorized user will have no recourse against Stars PH.
Points earned will
be recorded in a member’s Stars PH Account, and is only available for redemption when the member has
reached the specified fulfilment level as determined by Stars PH. Points may not be transferred to
other accounts nor pooled together in any manner and the sale or barter of Points is strictly
prohibited. Points has no monetary value, and cannot be used for any purpose other than redeeming
the reward. Once used, the Points is non-refundable.
Stars PH reserves the right
to change the type of activities through which Points may be accrued and to vary the frequency that
members get invited to such activities. The rewards offered and fulfilment levels required for
redemption of Points are subject to change. All rewards are subject to
availability.
You agree not to use the Platforms in any way other than in good
faith, including, but not limited to, providing false answers. Stars PH reserves the right to adjust
Member’s accrued Points amount or deny redemption of any Points if any Member’s survey responses
contain (or are suspected to contain) falsified data or is deemed inaccurate by Stars PH’s
standards, for which we have full discretion and authority.
Phone numbers, email
addresses or personal unique identifiers for reward claims linked to your Stars PH Account should
not be shared or used with other Stars PH Accounts. In the event of any suspicious activity that
leads Stars PH to believe that an individual is collecting and redeeming Points on several accounts,
Stars PH reserves the right to deny redemption of any Points and suspend and cancel all of the
affected Star PH Accounts.
Stars PH reserves the right to take any necessary
measures to remove or suspend any users suspected of misuse, inappropriate activity or
impersonation. In the event of noncompliance, misuse, impersonation or fraudulent activity of any
users, Stars PH reserves the right to take legal action against
users.
Stars PH reserves the right to terminate any Stars PH Account that
has been dormant (where the member has not accessed and/ or engaged with Stars PH’s survey mobile
application) for a period of 12 months or more. Accrued Points for terminated accounts will be
forfeited.
SURVEY-MAKERS:
By
choosing STARS PH, you gain powerful tools for data processing and cleansing, tailored to meet your
needs. While the platform strives to provide a seamless experience, it's important to note that any
outcomes resulting from your data activities are within your control. The insights you derive,
whether they benefit you or present challenges, are solely your responsibility. Once a survey is
completed and responses are submitted, they are considered final.
When a
company subscribes to the platform, the individual who accesses it on the company's behalf is
recognized as the authorized representative, bearing full responsibility for all actions taken
within the platform
ACCOUNT
MANAGEMENT
If
you have been issued an account by Stars PH in connection with your use of the Services, you are
responsible for safeguarding your password and any other credentials used to access that account.
You, and not Stars PH, are responsible for any activity occurring in your account (other than
activity that Stars PH is directly responsible for which is not performed in accordance with your
instructions), whether or not you authorized that activity. If you become aware of any unauthorized
access to your account, you should notify Stars PH immediately. Accounts may not be shared and may
only be used by one individual per account.
Stars PH occasionally sends notices
to the email address registered with your account. You must keep your email address and, where
applicable, your contact details and payment details associated with your account current and
accurate.
Stars PH may terminate your account and delete any Content contained in it if
there is no account activity (such as a log in event or payment) for over 12 months. However, we
will attempt to warn you by email before terminating your account to provide you with an opportunity
to log in to your account so that it remains active.
NON-DISCLOSURE
Information
and content made available to you on the Platforms may be of a confidential or proprietary nature
including, but not limited to, survey content. You must hold in strict confidence and not disclose
to any other person any information and content that you access or learn in connection with your
participation in any survey or activity on or related to the Platforms.
You must not
use any such information or content for any purposes, including for commercial purposes, other than
in accordance with these Terms. If you breach this obligation, in addition to the forfeiture of your
Points and termination of your Stars PH Panel account, you may be liable for damages to Stars PH
and/or our clients caused by the result of your breach.
You hereby agree to notify
Stars PH immediately if you learn or suspect any use or disclosure of, or access to, any such
information or content other than as specifically authorized in these Terms.
REFERRAL
LINKS
For
survey respondents, you may be able to earn extra Points by referring friends and family to the
Stars PH Panel, provided they join using your unique referral link. The conditions attached to the
awarding of such extra Points are explained in Stars PH’s mobile survey application.
When referring potential members, you agree not to pose as or claim to represent Stars PH and you
will not attempt to mislead or deceive prospective members into using your Referral Link to
join.
You agree to inform any prospective members you refer that they will be using your Referral Link and
that you will receive Points if they join the Stars PH Panel via your Referral
Link.
Stars PH reserves the right to restrict or deny redemption of any Points
claimed via Referral Links if users are found to abuse our Referral Links.
Stars
PH reserves the right to suspend or disable a members’ referral link should we find a reason to
suspect that member is abusing the Referral Links and or any other feature of the
platform.
USER
CONTENT
Use
of the Platforms may allow you to interact with or submit content to the Platforms, including
opinions, ideas, feedback or other information or content. This may be visible to other Members on
the Platforms or the general public.
While using the Platforms, you agree not
to:
Impersonate
any person (living or dead) or entity;
Forge headers or otherwise manipulate identities in order to disguise the origin of any content
transmitted or provided through using the Platforms;
Upload, post, link to, email or otherwise transmit any unsolicited or unauthorized advertising,
promotional materials, "junk mail", "chain letters", "phishing emails", "pyramid schemes", or any
other form of solicitation;
Collect, or store personal data about other individuals;
TERMINATION
If
you no longer wish to be a member, please contact Stars PH through any of the Platforms or at
[email protected]. Stars PH will then cease to contact you, subject to a 10-day administration
period. You therefore
acknowledge and agree that if you terminate your membership, you may continue to receive emails from
Stars PH for a period of 10 days thereafter. In terminating your membership, any accrued Points will
be forfeited.
You agree that Stars PH, in its sole discretion, may cancel or suspend your Stars PH Panel
account, prevent or restrict your use of the Platforms, or remove or discard any User Content, at
any time for any reason,
for which you or any third-party will have no recourse against Stars PH.
Stars PH reserves the right to terminate any of the Platforms for any reason at any time. In
such a case and unless specified otherwise, any Points accrued in any Stars PH Accounts may not be
redeemable by any Member.
Stars PH will endeavor to communicate to all Members the termination period. However, Stars PH will
not be liable for failure to notify any Member regardless of the reason.
DISCLAIMER
OF WARRANTIES
You
expressly agree that your use of the Platforms is at your sole risk. All Platforms and content on
the Platforms are provided on an “as is” and “as available” basis. Stars PH does not represent or
warrant that the information accessible via the Platforms is accurate, complete, or current. You
hereby release Stars PH, its subsidiaries, affiliates, and third-party providers from all liability
regarding the redemption and use of any rewards, including any rewards that, after receipt, may be
lost, stolen or destroyed.
Stars PH disclaims all warranties, whether express or
implied, including but not limited to any implied warranties of merchantability, of fitness for a
particular purpose, of results, and of accuracy or completeness or privacy or security of
information.
Stars PH further disclaims any warranties of uninterrupted use, operation,
or availability of the services or any content, or that any submission or transaction request you
attempt using the Platforms will be successful, uncorrupted, or completed within a reasonable amount
of time.
INDEMNITY
You
hereby agree to indemnify and hold harmless Stars PH, its subsidiaries, affiliates and agents, and
each of its respective directors, officers and employees from and against any and all liability,
damages, losses, claims (including but not limited to reasonable legal fees) resulting in any way
from your use of the Platforms or resulting from any breach of these Terms, whether such breach is
carried out by you or by any other person through your Stars PH Account.
GENERAL
All
notices given by Stars PH to Members will be sent through the Platforms or sent to Members’
designated email addresses as provided during the Stars PH Registration Process.
Stars
PH reserves the right to take legal action against you to recover any losses, damage, liabilities,
costs or expenses that we suffer or incur as a result of your breach of these Terms and to enforce
any right or remedy that we have at law. Stars PH’s failure to act with respect to a particular
breach does not constitute a general waiver of Stars PH’s right to act with respect to subsequent or
similar breaches.
Any provision of these Terms that is found to be invalid,
unlawful, or unenforceable by applicable law will be severed from these Terms, and the remaining
provisions of these Terms will continue to be in full force and effect.
These
Terms shall be governed by the laws of Philippines and you agree to submit to the exclusive
jurisdiction of the Philippine court system.
LANGUAGES
These
Terms have been drafted in the English language. In the event of any inconsistency between the
English version of these Terms and any of its translations, the English version shall
prevail.
PERSONAL
DATA
You
hereby expressly consent to Stars PH’s collection of your personal data including, your name, e-mail
addresses, internet protocol or MAC addresses through the use of cookies, or such other personally
identifiable information that may be requested under the Stars PH Registration Process in order to
provide the above-mentioned services on the Platforms to you. In the event that you do not consent
to the provision of your personal data, we will not be able to proceed with the creation of your
Stars PH Panel account nor will you be permitted to participate in any Stars PH activities or
surveys, or use any of our Platforms.
When participating in the Stars PH Panel or any
other surveys or activities on the Platforms, it may be necessary for us to use your personal data
in order to verify the suitability of the respondents to the surveys and we may also provide your
anonymized personal data to our clients for the same purpose. From time to time, it may also be
necessary to disclose your personal information to our IT service providers. In agreeing to create
your Stars PH Account, you also consent to such disclosures.
You have the right to
access any of the personal information provided to Stars PH at any time. You may amend, correct,
update or delete your personal information by accessing your Stars PH Account. However, please note
that if insufficient personal information is provided to Stars PH, it may no longer be possible to
maintain your Stars PH Account, participate in the Stars PH Panel or access the Platforms. Upon any
amendment, update or correction being effected, you consent to us updating any party to whom your
personal data had been previously provided to as well as to use your updated, corrected or amended
personal data to continue to provide the services herein.
